District Grant Funding & Assistance

1. Legal Basis
This policy is adopted pursuant to California Assembly Bill 2019 (AB 2019, Aguiar-Curry), enacted September 5, 2018, which amended the Local Health Care District Law (California Health and Safety Code Sections 32132.96, 32139, and 32140, and Government Code Section 6270.7). AB 2019 imposes specific requirements on health care district boards regarding grant funding, website disclosure, bankruptcy notification, and affordable housing in design-build projects. In compliance with California Health and Safety Code Section 32139, the Board of Directors shall adopt this annual grant funding and assistance policy and ensure it is published on the District's official website. 

2. Grant Funding Policy & Website Disclosure
The District will post annual Grand Funding information to the District Financials portion of the website. For purposes of this policy, Grant Funds or Assistance is any monetary grants, in-kind resources, or other financial assistance distributed by the Mendocino Coast Health Care District (the "District") to individuals, organizations, or community programs.

3. Bankruptcy Notification
In compliance with California Health and Safety Code Section 32140, if the District files a petition under federal bankruptcy law, the Board of Directors shall provide written notice within ten (10) business days to the Local Agency Formation Commission (LAFCO) of the principal county in which the District is located (Mendocino County). Such notice shall include the date of filing, the applicable federal court, and the case number. The District Administrator shall be responsible for preparing and transmitting this notice on behalf of the Board.

4. Administration & Responsibilities
The Board shall adopt and annually review this policy, ensuring that any authorized grant funding plan and corresponding recipient list are published to the District website, and authorizing bankruptcy notification to LAFCO if applicable. Any policy amendments shall be adopted by formal Board action and posted to the District website within five (5) business days of adoption.
